1. Scope of application

Tomorrowlabs is a trademark of Tomorrowlabs GmbH and its object is trade in skincare products. By purchasing a product from Tomorrowlabs  the following terms come into effect, which you agree to by the way of placing the initial order. Tomorrowlabs GmbH acts as the contractual partner of the customer. We reserve the right to change the terms and conditions in accordance with technical or legal necessities. Even if those changes should render parts of the terms and conditions at hand ineffective, this has no effect on the remaining content of this agreement.

2. Individual data

The customer is responsible for the full and truthful submission of his personal data during registration. He is further responsible for treating his personal login information confidentially. 

3. Conclusion of contract

The representation of the products in our online store, online showroom and the online configurator is consistent with a legally non-committal online catalogue. Only by clicking the button “place order”, the customer places a binding offer to buy the products within the shopping cart for the prices stated. Afterwards, the customer momentarily receives a confirmation of his or her order via email. We reserve the right not to accept particular registrations or particular orders of already registered customers without disclosing our reasons for doing so. There exists no obligation on our part to always keep available the products and offers on our website. Already confirmed purchase orders are exempt from this. 

4. Quality

Ou products are designed by scientists and are formulated and produced according to the strictest quality criteria. Should you be dissatisfied with our products please send a detailed description and photos to info@ tomorrowlabs.at.

 5. Payment

For all orders placed online, the payable prices are those shown at the time of placing the order. Prices include the Value-Added-Tax. The price is payable without discount or rebates. By placing an order, the customer agrees to receive invoices and possible credit information strictly by electronic means (email). Payment information is to be provided during the ordering process. In case of payment with credit card, the corresponding account gets charged upon completion of the order. In case of advance payment, the payment is due when the customer receives the order confirmation. Any credit amount on the customer´s account with Tomorrowlabs cannot be redeemed in cash or transferred to third parties.

6. Reservation of proprietary rights

We reserve the right of property to all shipped goods until the customer has made full payment. 

7. Gift coupon

Gift coupons are only valid until the specified date. Each coupon can be used only once during an ordering process. Transferring the coupon to a third party is not possible. Any unused balance will be credited to your account. The unused balance expires one year after issuance of the coupon. If the value of the purchase exceeds the amount of the coupon, the balance must be fully paid using a different payment method. Gift coupons cannot be disbursed in cash and cannot be used to buy other gift coupons. The gift coupon will get refunded in the form of another coupon of the same amount if ordered goods get fully or partly returned in accordance with the contents of this agreement. If the gift coupon was issued in the context of a marketing action and without a money consideration by the customer, the coupon cannot get refunded if the ordered goods get fully or partly returned in accordance with the contents of this agreement. The risk of loss and ownership of gift coupons is transferred to the buyer or recipient via either electronic transmission or when handed over to the courier service. We accept no liability for loss, theft, destruction or unauthorized use of the gift coupon.

8. Shipping

For the shipment of our goods, we use qualified service providers. The customer is responsible for accepting the ordered products and confirming the acceptance. The shipping costs as stated on the homepage of Company of Glovers are to be paid by the customer. The shipment of goods takes place on behalf and at the risk of the customer on weekdays to the customer or (if the customer has not expressly prohibited this in his or her order) to a person encountered at the delivery point or a person designated by the customer in the order. The transfer of risk from the seller to the buyer happens when the shipment is handed over to the service provider. The required delivery period as estimated by the service provider and as communicated to our customers can increase due to defacing circumstances in the form of force majeure. In such a case, no compensation for damages is due. The obligation of timely shipment of goods to customers does not apply if Tomorrowlabs has not received required shipments of its own in proper time. If goods are non-available due to any reason, we will immediately refund any payments made by the customer. 

9. Right of withdrawal

The satisfaction of our customers is dear to us. We always try to offer high-class products and a flawless service. Unfortunately it is not possible for customers to withdraw from purchases of products that are made based upon specifications provided by the customer. We kindly point out that such orders are to be considered remittance work and are therefore non-returnable. Customers are entitled to withdraw from purchase of non-remittance work articles within 14 days after delivery if the article acquired from Tomorrowlabs does not correspond with their expectation despite the aforementioned efforts. If you make use of your right of withdrawal, we kindly ask you to send the goods back using the original packaging. Please point out any damages to the shipment at the time of them being handed over by the service provider responsible for the shipment. To exercise the right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post, fax or scanned and sent by email) to Tomorrowlabs GmbH, 1010 Vienna, Michaelerplatz 6/18 or: info@tomorrolabs.at.

10. Warranty

Customers in accordance with legal regulations can make warranty claims. The legal warranty period´s length is 24 months. In case of manufacturing defects, we ask you to contact our sales support. The information on our homepage was carefully checked and is updated regularly. However, no assurance can be given that all information is always complete, accurate and up to date.

11. Applicable law and place of jurisdiction

The application of Austrian law is agreed for all transactions under the exclusion of the UN Sales Convention. The place of jurisdiction is Vienna. The contracting party is Tomorrowlabs GmbH, 1010 Vienna, Michaelerplatz 6/18, FBNr. FN 456205s; Handelsgericht Wien; UID.:
